Terms of Service

These Terms of Service (“Terms”) govern your use of the Calmio: Mood & Mindful Habits mobile application (“Calmio”, “App”), operated by Gesla LLC (“we”, “our”, or “us”).

By accessing or using Calmio, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Use of the App

Calmio provides wellness and mindfulness tools, including:

• Mood tracking and emotional reflection
• Guided mindfulness and relaxation sessions
• Daily intentions and habit building
• Sleep support and calming sounds

You agree to use the App only for lawful and personal purposes.

2. Not Medical Advice

Calmio supports general well-being and mindfulness. You understand and agree that:

• The App does not provide medical or mental health diagnosis, treatment, or advice
• Content is for informational and relaxation purposes only
• The App is not a substitute for professional care — if you have concerns about your mental or physical health, consult a qualified professional

3. User Content

You may record content in the App such as mood check-ins, reflections, and notes. You retain ownership of your content, but you grant us a non-exclusive, worldwide license to use, store, and process it for:

• App functionality
• Personalization of your experience
• Improvement of services

You agree not to submit illegal, harmful, or offensive material, or content that violates third-party rights.

4. Prohibited Use

You must not:

• Reverse engineer, copy, resell, or modify the App
• Attempt to disrupt or damage the service
• Use the App for fraudulent or illegal activities
• Exploit App features in unintended ways

5. Intellectual Property

All content, branding, design, audio, and software in Calmio is owned by Gesla LLC or its licensors and is protected by applicable intellectual property laws. You may not copy, distribute, or reuse any part of the App without permission.

6. Subscriptions & Payments

Some features may require payment or a subscription.

• Payments are handled through the Apple App Store
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription at any time in your Apple ID account settings
• Fees are non-refundable unless required by law or platform policy
• We may change pricing with notice

7. Service Availability

We may interrupt the service for maintenance, updates, or other changes, and, within the limits of law, may suspend or terminate the service. The service may also be unavailable due to events outside our reasonable control (force majeure).

8. Termination

We may suspend or terminate your access if:

• You violate these Terms
• We detect misuse or harmful behavior
• We are required by law

You may stop using the App at any time.

9. Disclaimer of Warranties

To the maximum extent permitted by law, Calmio is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or relating to your use of, or inability to use, the App
• We are not responsible for third-party actions, services, or content
• Our total liability shall not exceed the amount you paid to us in the preceding 12 months

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold Gesla LLC harmless from any claims, damages, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights or applicable law.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the App after updates means you accept the revised Terms. Please check regularly at appcalmio.com.

13. Governing Law

These Terms are governed by the laws of Georgia. Any disputes shall be resolved in the courts of Tbilisi, Georgia. If you qualify as a European Consumer, mandatory consumer protection provisions of your country of residence remain unaffected.
